The New Government Procurement Act (NGPA) or Republic Act No. 12009 was enacted on 20 July 2024, and subsequently published on July 29, 2024 in the Manila Bulletin and Business Mirror. This Act will take effect on 13 August 2024.

Section 112 of the NGPA provides that the Implementing Rules and Regulations (IRR) of the NGPA shall be finalized and approved by the Government Procurement Policy Board (GPPB) within 180 days from the promulgation of this Act, while the standard forms of procurement shall be completed and established within 90 days from the approval of the IRR.

On the other hand, Section 113 provides that pending the approval of the IRR of the NGPA, the IRR of Republic Act No. 9184 will remain in force to ensure the continued implementation of programs, activities, and projects. Under the same section, RA 12009 mandates the GPPB, Head of Procuring Entities, all Procuring Entities, and the Bids and Awards Committees to fully implement the requirements of RA 12009, within a 3-year transitory period from the approval of the procurement standard forms.
