Request for exemption from strict adherence to the government procurement system for the procurement of goods, infrastructure, and consultancy contracts for the PALARO 2007.

[T]he GPPB is not legally authorized to grant exemptions from the implementation of R.A. 9184 and its IRR-A. The GPPB's primary mandate is to provide policy direction in the field of public procurement. It cannot exercise functions beyond the scope of its authority.

As a general rule, procuring entities shall adopt public bidding as the mode of procurement. Alternative methods of procurement shall be resorted to only in highly exceptional cases, the determination and approval of which rests primarily with the head of the procuring entity, upon the recommendation of the BAC and whenever justified by the conditions provided for under Sections 49-53 of the IRR-A of R.A. 9184 (Section 12, R. A. 9184 and Section 48, IRR-A).
